Who is responsible for processing your personal data?

Benjamín Ricardo Wesseling Hidalgo is the DATA CONTROLLER for the processing of the USER’s personal data and informs you that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD).

Why do we process your personal data?

To maintain a commercial relationship with the user. The planned operations for processing are:

  • Sending commercial advertising communications via email, fax, SMS, MMS, social networks, or any other electronic or physical means, present or future, that allow commercial communications. These communications will be carried out by the CONTROLLER and related to their products and services, or those of their collaborators or suppliers with whom a promotional agreement has been reached. In this case, third parties will never have access to personal data.

  • Conducting market research and statistical analysis.

  • Processing orders, requests, responding to queries or any type of request made by the USER through any of the contact forms available on the CONTROLLER’s website.

  • Sending online newsletters about news, offers, and promotions in our activity.

What is the legal basis for processing your personal data?

Processing is legally based on Article 6 of the GDPR as follows:

  • With the USER’s consent: for sending commercial communications and newsletters.

  • For the legitimate interest of the CONTROLLER: for market research, statistical analysis, and processing orders or requests made by the USER.

How long will we keep your personal data?

Data will be kept no longer than necessary to maintain the purpose of the processing or as long as legal obligations require their custody. When no longer needed, they will be deleted using appropriate security measures to ensure anonymization or complete destruction.

Who do we share your personal data with?

No personal data is planned to be disclosed to third parties unless necessary for the development and execution of processing purposes, to our communication service providers, with whom the CONTROLLER has signed confidentiality and data processing agreements required by current privacy regulations.

What are your rights?

The USER has the following rights:

  • The right to withdraw consent at any time.

  • The right of access, rectification, portability, and erasure of their data, and to restrict or oppose its processing.

  • The right to lodge a complaint with the supervisory authority (www.aepd.es) if they believe that the processing does not comply with current regulations.

Required or Optional Nature of the Data Provided by the User

By checking the relevant boxes and entering data in the fields marked with an asterisk (*) in the contact form or download forms, USERS expressly and freely accept that their data is necessary to fulfill their request. The inclusion of data in the remaining fields is voluntary. The USER guarantees that the personal data provided to the CONTROLLER is truthful and is responsible for communicating any changes. The CONTROLLER informs that all requested data is mandatory as it is necessary to provide optimal service. If not all data is provided, the information and services offered may not fully meet the USER’s needs.

Security Measures

In accordance with current regulations on personal data protection, the CONTROLLER complies with all GDPR and LOPDGDD provisions for processing personal data, and with the principles outlined in Article 5 of the GDPR: processed lawfully, fairly, and transparently in relation to the data subject and relevant, limited to what is necessary.

The CONTROLLER has implemented appropriate technical and organizational policies to apply the security measures set forth by the GDPR and the LOPDGDD in order to protect USERS’ rights and freedoms and has provided them with appropriate information to exercise them.

Who is responsible for processing your personal data on social networks?

Benjamín Ricardo Wesseling Hidalgo, hereinafter CONTROLLER, informs the USER that they have created a profile on Facebook, Instagram, Twitter, LinkedIn, YouTube, Vimeo, and Google+ and are responsible for the processing of the user’s data carried out on these networks, in accordance with Regulation (EU) 2016/679 of 27 April (GDPR) and Organic Law 3/2018 of 5 December (LOPDGDD). The following processing information is provided:

Why do we process your personal data on social networks?

Purpose: To maintain a relationship between the USER and the CONTROLLER that may include:

  • Handling requests and inquiries made to the CONTROLLER.

  • Informing about activities and events organized by the CONTROLLER.

  • Informing about products or services offered by the CONTROLLER.

  • Interacting through official profiles.

Legal Basis for Processing:

Article 6.1.a of the GDPR: the data subject has given consent for processing their personal data for one or more specific purposes. The USER has a profile on the same social network and has chosen to follow the CONTROLLER’s profile, thus giving consent to process personal data made public on their profile.

The USER can access the privacy policies of the social networks at any time and configure their profile to ensure their privacy.

The CONTROLLER accesses and processes public information from the USER’s profile, especially their contact name. This data is used only within the social network and is not incorporated into any file.

How long do we keep your data?

Data will be kept as long as the USER does not revoke the consent given as specified in this privacy policy.

Who do we share your data with?

The information provided by the USER through the CONTROLLER’s social networks, including personal data, may be published depending on the services used by the USER and may be publicly accessible to other users of the networks.

The USER can manage their information visibility through their profile settings and revoke permissions or disable third-party applications.

No data is disclosed to third parties outside the social network unless necessary for the purposes stated and only to communication service providers bound by confidentiality and data processing agreements.

USER rights can only be exercised regarding information under the control of the CONTROLLER:

  • The right to withdraw consent at any time.

  • The right of access, rectification, portability, erasure, restriction, or opposition to processing.

  • The right to lodge a complaint with the supervisory authority (www.aepd.es).

2. Use of Social Media Profiles

The CONTROLLER may:

  • Access public information on the USER’s profile.

  • Post content already published by the CONTROLLER on the USER’s profile.

  • Send personal and individual messages through the social network’s channels.

  • Post status updates on the USER’s profile.

The USER can always manage their connections, delete unwanted content, and control privacy settings.

By following or joining the CONTROLLER’s social media profile, the USER may post comments, links, images, videos, or other media content. The USER must own the content or have appropriate rights or permission.

Publications that are offensive, unethical, or violate laws, intellectual property, image rights, or other regulations are strictly prohibited. In such cases, the CONTROLLER reserves the right to immediately remove the content and may block the USER permanently.

The CONTROLLER is not responsible for content posted by USERS.

Publications may be visible to other users, so USERS are responsible for their own privacy.

Images shared on social media will not be stored in any file by the CONTROLLER but will remain visible on the network.

3. Minors and Special Needs Individuals

Access and registration through the CONTROLLER’s social networks is prohibited for minors under 18. If the USER has special needs, they must be represented by a parent, guardian, or legal representative with valid documentation.

The CONTROLLER is not responsible for the use of social networks by minors or individuals with special needs. No personal data from minors is knowingly collected.

4. Blog Subscription – Consent for Processing

Benjamín Ricardo Wesseling Hidalgo is the controller of the user's personal data and informs you that the data will be processed in accordance with GDPR and LOPDGDD.

Purpose and Legal Basis: Subscription to the blog newsletter (based on the user’s consent, Art. 6.1.a GDPR).

Data Retention: Data will be kept no longer than necessary to maintain the subscription.

Data Disclosure: No data will be disclosed to third parties, unless required by law.

User Rights: The right to withdraw consent, and the rights of access, rectification, portability, deletion, restriction, or objection to processing.
